portupgrade apache+ssl fails on openssl trying to install the new version
and not upgrading openssl, that fails because the lower version is already
installed

after having upgraded openssl then install failes on chmoding the data-dist/
on line 422 and 423 of apache's Makefile

commenting them out the install concludes

Can you tell us, what portupgrade arguments you used? 

And is the compilation issue still valid with recent versions?
